50 UNITED STATES (EXCLUDING MA, MI & VA) OR IN THE DISTRICT OF COLUMBIA.
THIS SWEEPSTAKES WILL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW.

1. ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Open to smokers who are at least 21 years of age and legal residents of the 50 United States or District of Columbia (excluding Massachusetts, Michigan and Virginia) at time of entry. Employees of JT International U.S.A., Inc. (the “Sponsor”), its subsidiaries, agencies, affiliates, wholesalers, distributors, dealers, retailers, vendors, advertising and promotion agencies, and members of the immediate families (spouses and parents, siblings, children and their spouses and in-laws) and persons living in the same household of such individuals (whether related or not) are not eligible. Void in Massachusetts, Michigan, Virginia and where prohibited.
2. PROMOTION DESCRIPTION: : The Wave “SMOKE. PLAY. WIN.” Instant Win Game and Sweepstakes (the “Game”, “Sweepstakes” or “Promotion”) runs from 12:001 am Eastern Time (“ET”) on 10/1/13 through 11:59 pm ET on 12/15/13 (“Promotion Period”). Daily Prizes will be awarded during Game Play between 8:00 AM ET and 11:00 PM ET during each day of the Promotion Period. Entrants are invited to play one of three games at www.wavecigarettes.com for a chance to win an Instant Prize, and, to earn one entry into the Sweepstakes drawings. 76 Instant Win Prizes will be available (one per day of the Promotion). 11 Weekly Sweepstakes drawings will be held to award a Weekly Prize. Three First Sweepstakes drawings will be held to award a First Prize. And, one Grand Prize Sweepstakes drawing will be held at the end of the Promotion to award the Grand Prize. See Section 4 below for further details.
3. TO ENTER: To enter the Sweepstakes, visit www.wavecigarettes.com during the Promotion Period. If you do not already have a Wave account, follow the instructions to create one. Once you have created your account, access and play a game. Once you have played and completed a game, you will learn if you are an Instant Winner of a Daily Prize. You will also receive one entry into the sweepstakes drawings to be held according to the dates listed in Section 4 below. All entries must be received by 11:59 pm ET on 12/15/13. Sponsor’s webmaster/supplier’s computer is the official time keeping device of this Promotion.
LIMIT ONE GAME PLAY/ENTRY PER PERSON PER DAY. Participants may not play/enter more than permitted by using multiple/different email addresses, identities or other methods. Any entrant who plays/enters more than once, or uses any device or artifice to circumvent these Official Rules may be disqualified, have their entries void, and/or forfeit any prize won.
4. DRAWINGS/PRIZES/ODDS:
Instant Win Game Daily Prizes:
During each day, an Instant Win prize will be available to be awarded consisting of a Visa® gift card in the amount of $20. Prize is subject to terms and conditions stated on the card.
Each Participant will be logged by the game system and assigned a Participant Number in order of their commencement of the game (e.g., the first Participant will be assigned number 1, the second 2 and so on). Daily Instant Winners will be selected by a random number generated from an algorithm at the start of each day. The Participant whose Participant Number matches that day’s preselected winning number will be the Instant Winner and that Participant will be instantly notified upon completion of the game and will receive their prize within 8 weeks via mail. Prize will be sent to the address on record in winner’s Wave’ account. It is recommended that entrants check their account to verify all contact information provided is accurate. Prizes which are returned as undeliverable will be forfeited.
If an insufficient number of game plays/entries to reach the randomly drawn winning Participant Number are received on any given day, the unclaimed prize for that day will not be awarded. Odds of winning an Instant Win Daily Prize will be determined by the number of eligible participants and randomly selected winning play.
Sweepstakes Prizes:
(11) Weekly Prizes: On or about the following dates, a random drawing will be conducted by Promotion Mechanics, Inc., an independent judging organization, from among all eligible entries received prior to that drawing: 10/7/13, 10/14/13, 10/21/13, 10/28/13, 11/4/13, 11/11/13, 11/18/13, 11/25/13, 12/2/13, 12/9/13, and 12/16/13. Each drawing will award the following prize:
(1) Weekly Prize: a Visa® gift card in the amount of $100. Prize is subject to terms and conditions stated on the card.
(3) First Prizes: On or about the following dates, a random drawing will be conducted by Promotion Mechanics, Inc., an independent judging organization, from among all eligible entries received prior to that drawing: 10/14/13, 11/11/13, and 12/16/13. Each drawing will award the following prize:
(1) First Prize: $1,000 to be awarded in the form of a check made payable to the winner.
(1) Grand Prize: On or about 12/16/13, a random drawing will be conducted by Promotion Mechanics, Inc., an independent judging organization, from among all eligible entries received overall to award the following prize:
(1) Grand Prize: $5,000 to be awarded in the form of a check made payable to the winner.
Non-winning entries from one drawing will be retained and included in subsequent drawings. Sweepstakes winners will be notified by phone, email, and/or mail at Sponsor’s sole discretion. To claim the prize, winner must complete, sign and return any and all verifications and documents as required by Sponsor (see Section 5). Odds of winning a Weekly, First or Grand Prize will be determined by the number of eligible entries received prior to each drawing.
5. GENERAL: Taxes on prizes not specified in these Official Rules are the sole responsibility of winners. By participating, entrants agree (a) to these rules and decisions of judges which shall be final in all respects; (b) to release and hold harmless Sponsor, its subsidiaries, affiliates and agencies, wholesalers, distributors, dealers, retailers, vendors, advertising and promotion agencies and their respective directors, officers, employees, agents and representatives (the “Releases”) from any and all claims, demands, costs, expenses, liability, losses or damages of any kind resulting from their participation in the promotion or their acceptance, use, non-use or misuse of a prize, including liability for personal injury or death; (c) if a winner, to the use of name and/or photograph for advertising and publicity purposes without compensation (unless prohibited by law) and to execute specific consent to such use if asked to do so, and to the announcement of their name, city and state; and (d) that Sponsor and its agents have not made any representation, warranty or guaranty, in whole or in part, in law or in fact, relative to the prize. Weekly, First and Grand Prize Winners will be required to complete an affidavit or certification of eligibility and liability release and (where legal) a publicity release, which must be returned within the time period specified by Sponsor or an alternate winner may be selected. Return of any prize/prize notification as undeliverable may result in disqualification of winner and selection of an alternate winner. Releases are not responsible and shall not be liable for: (a) any telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; (b) failed, incomplete, garbled or delayed computer transmissions; (c) late, lost, incomplete, damaged or misdirected entries or mail; and (d) any condition caused by events that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel or suspend the sweepstakes or any portion thereof should viruses, bugs, or other causes corrupt the administration, security or proper play of the promotion; in which case prize will be awarded via a random drawing from among all eligible entries received prior to cancellation. No correspondence about entries will be entered into nor will entries be acknowledged or returned. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes, as set forth in these Official Rules, to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. In the case of any irregular game play, the sole liability and responsibility is replacement with another game play, while supplies last. In case of dispute, entries will be declared made by the authorized account holder of the email address used to participate at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email address for the domain associated with the submitted email address. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. In no event will Sponsor, its subsidiaries, affiliates and agencies, and their respective directors, officers, employees, agents and representatives be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the internet site www.wavecigarettes.com or other sites promoting the sweepstakes or the downloading from and/or printing material downloaded from said sites. Without limiting the foregoing, everything on this site is provided “as is” without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Entries become the property of Sponsor. No prize transfer. No prize substitution except at Sponsor’s sole discretion.
6. PRIVACY POLICY: : Information submitted with an online entry is subject to the Privacy Policy stated on www.wavecigarettes.com.
7. ARBITRATION/CHOICE OF LAW: Except where prohibited, entrants agree that (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any prize awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, in Bergen County, New Jersey, (b) any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (c) under no circumstances will entrant will be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages (other than for actual out-of-pocket expenses), and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Sponsor in connection with the promotion, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without regard for conflicts of law doctrine, and all proceedings shall take place in Bergen County, New Jersey.
